Part of the General Conditions of Tourist Rentals
a) In the following General Conditions, which govern the activity of the Coste del Sud Tourist Real Estate Agency, some terms have a specific meaning: – “COSTE DEL SUD” means the Real Estate and Tourist Agency that manages rental bookings . By “VILLEGGIANTE” or “LESSEE” we mean those who make a reservation for one or more published properties. – By “OWNER / I” or “LESSOR / I” we mean the owner / s (or whoever for him) of the property / s to be rented. b) COSTE DEL SUD acts in the name and on behalf of the OWNERS of the properties by virtue of a specific lease assignment, essentially dealing with publishing the properties to be rented on the website www.costedelsud.com and managing the related reservations, without providing any service onerous payable by the HOLIDAYS, let alone reception, check-in and check-out, collection of the balance, or other service inherent to the stay as they are entirely paid by the OWNERS or whoever for them, who will be solely responsible for these obligations . It is therefore specified that COSTE DEL SUD will not issue any invoices to the HOLIDAYS (who may request a receipt for payment, for the rent paid, from the LESSOR pursuant to Article 1199 of the Civil Code following the signing of a rental contract) as it will be obliged to do so only in against the OWNER and only in relation to the commission due to it.
2) CHARACTERISTICS OF THE PROPERTIES
The properties on the website www.costedelsud.com are essentially private structures used for tourism. Therefore, the information relating to the published properties has been provided by the respective OWNERS who assume all responsibility for any false declarations issued to COSTE DEL SUD and the LESSORS. All the properties are furnished and have a fully equipped kitchen or kitchenette (dishes, pots, fridge) except in the Bed and Breakfast formula. The supply of household appliances (washing machine, dishwasher, TV, etc.) is indicated in the description of each individual accommodation; bed, bath and kitchen linen are not provided (unless otherwise indicated on the accommodation card). Being private homes, they have different characteristics from each other. Therefore, any specific needs you may have must be clearly specified at the time of booking before defining the contract, in order to be able to provide for specific requests which will be entered in writing on the final confirmation.
The rental prices are per accommodation and per week and include: – the consumption of water, electricity and gas (unless otherwise indicated); – final cleaning (unless otherwise indicated); Any baby bed or extra bed (if available), must be requested strictly at the time of booking, and entail, unless otherwise indicated, an increase in the rental price. The apartments do not have umbrellas and deck chairs (unless otherwise indicated). Not included in the price (unless otherwise indicated in the price list): – bed linen and towels (for some accommodations it is possible to rent); – any heating and / or air conditioning costs (if available).
4) HOW TO BOOK
To book, fill in the “Booking Request” which you will find by clicking on the Book Now button; once you have filled in the request you will receive further details for sending a deposit equal to about 30% of the rental price, which once sent will confirm your booking. The balance will take place at the beginning of the stay: payments accepted: Cash (when permitted by law), Bank Transfer, Bank Checks. After having viewed the booked accommodation and at the same time as signing a regular lease contract for tourist purposes pursuant to Article 1, par. 2, lett. c), L. 9 Dec. 1998, n. 431 with the OWNER of the accommodation (or whoever for him); in addition to the balance, it will be necessary to issue a security deposit of € 100.00 to be paid upon arrival to the person who will welcome you, to guarantee any damage or non-compliance caused to the property, which will be returned to you at the end of your stay . It is clearly specified that the security deposit “is not included in the total rental price, but is separate”.
5) DURATION OF THE RENTALS
The minimum duration of the rentals, except in the low season, is one week, and will start on Saturday between 17.00 / 20.00 (if the accommodation is ready, even earlier, but at the discretion of the LESSOR) and will end on Saturday subsequent no later than 10.00 am (unless otherwise specifically agreed with the LESSOR). Any change regarding the arrival or departure times must be agreed in advance with the OWNER and is subject exclusively to the latter’s acceptance. There is no refund in the event that the Vacationer anticipates the departure or postpones the arrival.
6) RULES OF STAY AND CLEANING
The leased properties will be delivered clean and tidy; at the end of the stay the accommodation must be returned in the state in which it was entrusted to you, taking care, in particular, to wash the dishes used, to empty pantries, rubbish, refrigerator and to reposition any furniture or objects moved during your stay. Unless otherwise agreed, the holiday maker must also clean the surfaces (floors, bathrooms, kitchen, furniture). Any complaints regarding the cleanliness of the premises must be addressed exclusively to the LESSOR, as the sole person in charge of the accommodation as well as the holder of the rental contract. The Vacationer may not let people or animals stay different or in a higher number than indicated in the booking form, under penalty of termination of the contract and consequent loss of the sums already paid. Should the need arise for any additions regarding the number of occupants, before or during the rental period, the Vacationer must contact and agree on the changes with COSTE DEL SUD. It has already been specified that the number of occupants (adults and children) cannot in any case exceed the number of beds indicated in the catalog and / or on the website www.costedelsud.com. THE OWNER (or whoever for him) may prohibit the stay for people in excess.
7) MAINTENANCE – TROUBLESHOOTING
The owner, or his representative, will have the right to enter the leased unit to carry out routine maintenance work (cleaning the garden, swimming pool, etc.) or if he believes that there are serious reasons caused by uncivilized or unpolite behavior on the part of the guests. . In the event of faults, these must be promptly reported to the OWNER or his representative, who will arrange for appropriate repairs in the shortest possible time, compatibly with the nature of the fault, even in the absence of the Lessees. In any case, the repairs will be carried out having regard to the necessary technical times.
8) CANCELLATIONS OR INCONVENIENCES OF THE OWNER
Each accommodation has been visited and checked by COSTE DEL SUD. The descriptions given on the web pages are correct and written in good faith. Any and all liability linked to any flaws, defects and / or discrepancies of the leased property or any civil liability towards third parties arising from this shop or, in any case, to situations unrelated to its own mediation activity, is fully charged to the LESSOR. In any case, COSTE DEL SUD declines from any liability relating to: causes of force majeure (such as wars, natural disasters, fires, thefts, serious breakdowns of the plants); inefficiencies linked to causes beyond one’s control and / or unforeseeable; interruption of essential services by utility companies (eg water, gas, electricity); negligence or omissions attributable to third parties; discrepancies between the state of the accommodation and the photographic book published on its website www.costedelsud.com, due to any changes or alterations made by the owner without the knowledge of COSTE DEL SUD or by third parties, after the control carried out by the same. In case of problems, the Vacationer undertakes to do his best to solve them and minimize them together with the LESSOR, freeing COSTE DEL SUD from any responsibility in this regard. If due to force majeure the booked apartment is not available, it will be replaced with one of the same or higher category, located in a different place or location, and the published price list will be considered as a criterion of comparison. The holiday maker will be free to accept or not accept any alternative accommodation provided; however, the replacement of the accommodation, which respects the above terms, frees the Agency from further charges, requests and / or claims on the part of the Vacationer, who will not be able to make claims even as compensation for damages or other compensation.
The presence of animals, of any kind and type, is not allowed (mainly out of respect for those suffering from allergic diseases). However, you can make any requests to COSTE DEL SUD only at the time of booking, as in some cases it is possible that they are allowed (with a surcharge).
The holiday maker, a few days before arrival, must communicate to the OWNER (by contacting him by phone at the number provided by COSTE DEL SUD) the arrival time (for the purpose of reception) and the departure time (for the return of the property ), to facilitate the operations relating to the management of the lease, taking care, in particular, to respect the arrival time communicated as much as possible, and to vacate the property no later than the established time.
11) ASSIGNMENT AND WITHDRAWAL
The Vacationer who is unable to make use of the reservation made can transfer it to another person as long as the transferee has the same requisites; inform COSTE DEL SUD with at least 15 days notice with respect to the presumed arrival date. The transferor and the transferee will in any case be jointly responsible for the payment of the balance of the price, and any additional expenses. In case of early withdrawal from the contract,
The Vacationer will be required to pay the following sums as a penalty:
– cancellation communicated within 45 days of arrival penalty equal to the deposit paid only.
– withdrawal communicated between 44 days before and 31 days before first penalty equal to 50% of the balance in addition to the deposit paid.
– withdrawal communicated within 30 days prior to arrival penalty equal to 100% of the balance in addition to the deposit paid.
The notice of early withdrawal is made exclusively, under penalty of ineffectiveness, in writing, by sending a fax or an email to the COSTE DEL SUD addresses published on www.costedelsud.com.
12) EXEMPTION FROM LIABILITY
The Vacationer expressly exempts COSTE DEL SUD from any responsibility for direct and indirect damages that could derive from any innocent disservices, and by addressing his own possible complaints, relating to the accommodation or the disservice received after the acceptance of the “Rental Proposal”, exclusively towards the OWNER. The Vacationer, following the delivery of the keys, assumes the custody of the rented premises, cannot make any changes, innovations, improvements or additions of any kind, and undertakes to return them to the legitimate Owner in the same state in which they paid at the time of delivery. .
Any modification to this contract cannot take place, and cannot be proven, except by written deed.
14) FORUM AND LEGAL COMPETENCE
For any dispute concerning the execution of this contract, the exclusive jurisdiction of the Court of LECCE is agreed between the parties. However, the parties reserve the right to apply in advance to a Conciliation Body. Pursuant to and for the purposes of articles 1341 and 1342 of the Civil Code. the LESSEE declares to expressly approve the following clauses: 4) how to book; 5) duration of the leases; 6) rules of stay and cleaning; 7) breakdown maintenance; 8) cancellation or inconvenience of the owner; 11) transfer and withdrawal; 12) exemption from liability; 14) forum and legal jurisdiction; Information pursuant to Legislative Decree 196/2003 (PRIVACY) The COSTE DEL SUD Agency informs that personal data concerning the Villegiante are processed at its offices, consisting of: name, address, telephone numbers, etc. These data will be stored in special paper and computerized archives ; only the treatments strictly necessary for the execution of this assignment will be carried out. The provision is optional but in case of refusal the contract cannot be executed. Therefore he gives his consent to the processing of his personal data as specified in the above information.
